is the comelec chairman allowed to run as a president without giving his/her resignation letter?and can be the out going president at thesame time appointed his/her self as comelec chairma?

The Comelec Chairman also allowed to run as a President as long as he is qualified and the he must resign first as a chairman of the commission to avoid using the position and the fund of that particular office or it would be a violation of the law and of the constitution reasons to his early disqualification for the said position,the President could not appoint himself as a chair for the commission for the constitution would also be violated by him,appointing of any public official 100 days before the elections are strictly prohibited by law of the constitution,that is why even that he is out going for the end of tenure as a President he is prohibited by the law by doing so...
